Second formal complaint to Kilkenny Gardai about David Connellan.
5-12-2005. Page 1

Superintendent Garda Gordon Ryan.

Kilkenny City.

Dear Superintendent Ryan,
Under the Protections for Persons Reporting Child Abuse act 1998 section 5. I wish to make a further complaint against Mr. David Connellan c/o Detective Garda Liam Maher and Detective Garda John Bergan. Kilkenny Garda Station. Kilkenny.
Further to my previous statement about Mr. David Connellon dated 28-11-2005.I wish to state as follows;
Mr. Connellan in his statement to The Residential Redress Board Dublin has made multiple false, unfounded and untruthful allegations of child abuse against myself while he was a resident in St. Joseph’s Industrial School Kilkenny City.
I wish to make a formal complaint against Mr. David Connellan c/o Detective Garda Liam Maher and Detective Garda John Bergan. Kilkenny Garda Station. Kilkenny .

In his statement to the Redress Board, Mr. Connellan states points which I have disputed and numbered 1 to 19.

• 1. “[“Child's Father”] who was a worker at Summerhill for a brief period of time”.
I was not a worker in Summerhill.What Mr. Connellan has said is incorrect and misleading, and gives the wrongful and misleading impression against my correct and established title which was “Trainee Houseparent”. See page 59 line 7.

• 2. “Attempted to act in a highly inappropriate manner to me on a number of occasions”
At no time whatsoever did I act in a highly inappropriate manner with Mr. Connellan. What Mr. Connellan has said has never happened. His words are untruthful and without any foundation.

• 3. “When I say that he was making sexual advances to me”.

I did not ever make sexual advances to Mr. Connellan. What he has stated has never happened. His words are untruthful and without any foundation.
See page 59 line 9.

• 4. “He was making sexual advances to a number of boys in Summerhill”.
I did not ever make sexual advances to any of the boys in Summerhill.What Mr. Connellan has stated has never happened. Mr. Connellan’s words are untruthful, unfounded, slanderous and defamatory, and inflicted by him against my good name as a man and as a Father. See page 59 line 10.

• 5.”I would say that at this stage I was in a deep state of depression”
I submit that on his own admission that at that time he suffered from a deep depression, would therefore render any testimonies by Mr. Connellan as being unsafe, unreliable, questionable, and render him to be an incredible witness.

• 6. “However I was well aware that if [Child's Father] saw any sign of weakness he would move in on the person”
At no time whatsoever did I move in on a person or take advantage of a sign of weakness to move in on a person. Mr. Connellan’s words wrongfully imply that I would take advantage of any vulnerable person. What Mr. Connellan has stated is untruthful and without any foundation. What he has implied has never happened. His words are slanderous and defamatory against my good name as a person, a man, and as a Father. See page 59 line 12.

• 7. “On one occasion when [Child’s Father] came down to me apparently to console me”
Mr. Connellan has used his words “apparently to console me” to wrongfully imply that while on a mission of compassion and kindness, that my intentions were for inappropriate behavior of a serious sexual
nature against myself. His words are misleading, wrongful, and without any foundation whatsoever. The event that Mr. Connellan has stated has never happened.

• 8. “he was in fact making sexual advances at me”.

I did not ever make sexual advances at Mr. Connellan. What Mr. Connellan has stated has never happened. His words are untruthful and unfounded.

• 9. “I pushed him away”.
I never pushed Mr. Connellan away. What Mr. Connellan has stated has never happened. His words are untruthful and unfounded.

• 10. “I recall [Child’s Father] had a very violent behavior and he would discipline the boys by punching them straight into the mouth”.
I never had a violent behavior. I am not a violent person. All discipline was given by the person in charge of the boys unit. And that person was a Nun. I never disciplined the boys, and I did not ever punch any of them straight into the mouth. Mr. Connellan’s words are untruthful and unfounded, and what he has said has never happened.

• 11. “One incident that I recall with particular concern was”

Mr. Connellan’s use of the word “concern” implies that he had a considered just and honorable reason to comment on his complaint against myself. I submit that Mr. Connellan’s use of the word “concern” is misleading, and wrongfully implies that he had a just and honorable reason for his complaint.

• 12. “[Child’s Father} would give us certain chores to do and on one occasionmy chore was to clean the outside windows of the building”.
I never gave Mr. Connellan a chore of cleaning the outside windows of the building.What Mr. Connellan has said has never happened.His words are untruthful and without foundation.

• 13. “I was carrying this out with another boy and when we were finished we went off down to play on the soccer field”.

This event has never happened. Mr. Connellan’s words are untruthful and without any foundation.

• 14 “Before I went down I approached [Child’s Father] to ask could I finish the windows later on and go and play ball with the rest of the boys”

This event has never happened. Mr. Connellan’s words are untruthful and without any foundation.

• 15. “I was told that I was not allowed”.

I did not tell Mr. Connellan that he was not allowed. . Mr. Connellan’s words are untruthful, and what he has said has never happened.

• 16. “I had an argument with him and I was pushed to the ground”.

I did not have an argument with Mr. Connellan, and I did not push him to the ground. What Mr. Connellan has stated is untruthful and without any foundation. These events have never happened.

• 17. “At this point I realized that [Child’s Father] was in a state of sexual arousement”.
I was never in a state of sexual arousement at any time whatsoever with Mr.Connellan. Up to that time, and for twenty years after, I had suffered from a penile dysfunction. This condition was caused by a restricted frenulum and a tight redundant foreskin.

There was a severe restriction of the normal advancement of my penis. Any erection would result in excruciating pain and discomfort resulting from the strangulation of the glans by the tight frenulum and redundant foreskin. I had no interest in sexual conduct because it was painful. And I believed that it was very sinful. See medical report dated 26-5-2004 by Dr.P.A.Mc Lean.

• 18. “and he attempted to rape me”.

At no time whatsoever did I ever attempt to rape M. Connellan. I was unable to have an erection owing to a penile dysfunction. Mr. Connellan’s words are untruthful and without any foundation. What he has stated has never happened.

• 19. “I struggeled and I managed to get free and I run off”.

This event has never happened. . Mr. Connellan’s words are untruthful and unfounded.


• 20. “I think that this incident would have happened when I was approximately fifteen years old”

Mr. Connellan was aged fifteen on 2-6-2005. See attached birth cert. page 34. I had left St. Joseph’s a year earlier in April 1974. I submit that since I was not living and employed in St. Joseph’s at the time of Mr. Connellan’s alleged abuses by myself. This would confirm that his words about myself are untruthful, and without any foundation.

During my short stay in St. Joseph’s Industrial School, which was for seven months in 1973-1974. I knew Mr. Connellan to have been a deeply disturbed boy. He was a persistent liar, devious, suspicious, dishonest, cunning, defiant and unfriendly with me. He was fourteen
years of age, and was part of a gang like group of boys that lived in the Summerhill unit which was part of St. Joseph’s Industrial School.

He did not respond to any efforts that I made to gain his trust and co-operation. He did not respect or respond to the house rules. He did what he liked, and when he liked, and was very introvert.

Mr. Connellan never told me anything about himself, and I was never told anything about his history or anything about the history of anyone in the boys unit or any history about the School.

I am shocked and surprised at Mr. Connellan’s allegations against me. What he has said about me in his allegations is untruthful and the events stated have never happened. His words are unfounded, slanderous and defamatory against my good name as a person, a man and as a Father.

Were the Gardai aware of Mr. Connellan’s admission of deep depression at the time of his alleged abuse? If so, why did the Gardai take his statement and act upon it? And why did his solicitor’s Michael Lanigan & Co. of 1 High Street Kilkenny take his statement, act upon it, and present it to the Residential Redress Board on behalf of their client in a claim for redress?
Mr. Connellan has also named Terresa Connolly and Mr. David Murray in his statement to the Redress Board.

The only allegation read out to myself by Det.Sergeant Liam Maker on 8-11-2002 was that Mr. Connellan had alleged that I had “pressed against his bottom while at a party”.

Another man, Mr. William Heffernan, who at the same time had lived with Mr. Connellan in the same unit at St. Joseph’s also made a statement for a claim for redress in 2003. In an explicit reference to the “group”, Mr. Heffernan states that “we tended to stick together”

Mr Heffernan has named six people on his application to the Board declared and signed by him on 2-4-2003.
I wonder have the Gardai ever seen any statements of claim presented to the Residential Redress Board by solicitors Michael Lanigan & Co.Kilkenny ?
I wonder have the Gardai ever seen any statements by any individuals who have claimed compensation for their alleged child abuse to the Board ?
I suspect that there has been collusion among that group with malicious intent to wrongfully place guilt upon an innocent person named by them.

I believe that certain members of that group from St. Joseph’s made in 1995 contain contradictory evidence.
In addition to this, statements made by the same men in 2002/2003 to the Redress Board contain more contradictory evidence , and new evidence mainly of a sexual nature.
Higher awards of money are made to those who claim sexual abuse in their applications to the Board.
In a statement made by Mr. Laetiff Bashorum on 24-7-1995 and witnessed by Det.Sergeant Garda William Maher and Sergeant John Tuohy, there is evidence that Sgt.Tuohy informed Mr. Bashorum that Terresa Connolly admitted sexually abusing him. But Mr. Bashorum denied it. Is this an established procedure used by the Gardai in their efforts to gain a conviction ?

Mr. Bashorum’s statement to the Redress Board on 23-4-2003, he states that “I was sexually abused by Terresa Connolly”.
See page 39 line 5.

Mr. Bashorum in his statement made on 24-7-1995 says “David Murray never sexually assaulted me”
